When the young man died, his elderly parents contacted the hospital where their son’s sperm had been cryopreserved. However, the hospital refused to release the sperm sample, due to which the family was very sad and they approached the Delhi High Court with the hope of getting this sample.
The case went on in the court for more than 4 years and finally the Delhi High Court has now ordered the hospital to hand over the frozen sperm samples of the deceased daughter to the elderly couple for surrogacy. The court said in its order that Indian law does not prohibit posthumous reproduction if there is consent. The law of the country considers the sperm sample as a person’s biological material and considers it the person’s property. The court heard this matter last week and took an important decision. Experts are considering this decision of the court as historical.
What is sperm freezing and why do people get it done?
Dr. Shivali Tripathi, senior consultant and IVF specialist at Apollo Fertility, Varanasi, UP, told AyraNews24x7. Sperm freezing is a process of storing sperm or testicular tissues by freezing them at extremely low temperatures. This process is also called cryopreservation. In this, men’s sperm are frozen in liquid nitrogen after necessary testing. Then it is stored and kept. Through this process you can easily preserve sperm for many years. When needed, it can be removed and used for conception. Frozen sperm remains safe by 50-70% in extremely low temperatures.

Doctor Shivali told that in today’s time the trend of sperm freezing is increasing. People choose the option of sperm freezing so that they can easily have children in the future. If a man suffers from any disease, he gets it done so that a child can be born through it in the future. These days, many people do not marry for a long time due to their career and studies and get their sperm frozen. This relieves them from the tension of not having children in the future.
According to experts, men who go for chemoradiation for cancer treatment, get their sperm frozen before that, so that they can become fathers in the future without any problem. Only a healthy person can donate sperm. People can donate their sperm only after being checked for all infections. Many types of tests are done before freezing sperm. In this, the sperm donor is examined for medical, genetic, infectious and psychological diseases.
