Many children have been deprived of their educational rights.
DM Gangwar reprimanded the operators of these major schools for not giving admission under RTE.
IAS officer DM Suryapal Gangwar has taken a decisive step to implement the Right to Education in Lucknow and issued a 7-day ultimatum to 62 schools to admit children under the RTE Act. If these schools do not do so, they will be sealed on the eighth day. During a meeting at the Collectorate, DM Gangwar reprimanded the operators of these prominent schools for not giving admissions under RTE, affecting about 1100 children eligible for admission in these institutions. Due to these admission lapses, many children have been deprived of their right to education.
In response, DM Gangwar has asked these schools to expedite the admission process. Suryapal Gangwar’s strict stance is aimed at ensuring that the children of Lucknow can fully avail their rights under the Right to Education.
The Tamil Nadu government on Tuesday told the Madras High Court that it cannot implement the RTE Act in CBSE and ICSE schools as, unlike matriculation schools, these schools are not subject to a government-prescribed fee structure.
State counsel A Edwin Prabhakar made the statement before the first bench of Acting Chief Justice R Mahadevan and Justice Mohammad Shafiq when a petition filed by V Eswaran of Marumalarchi Makkal Iyakkam, Coimbatore, regarding admissions under the RTE Act came up for hearing.
The counsel for the petitioner argued that some schools in the state were refusing admission because the distance between home and school was one kilometre. He asked the court to direct that schools teaching under CBSE and ICSE curriculum should also come under the purview of the RTE Act as the state government has the power to do so.
The government argued that it fixes the fee structure for matriculation schools and based on that structure, it pays the fees of students admitted under the RTE Act. Since the government cannot fix the fee structure for CBSE and ICSE schools, it is unable to implement the Act in those schools.
