The Narendra Modi government on Monday introduced a bill in the Lok Sabha to prevent malpractices such as paper leaks and fake websites in various government recruitment exams, with stringent penalties including imprisonment of up to 10 years and minimum fine. Rs 1 crore for those involved in such organized crimes.
The Public Examinations (Prevention of Unfair Means) Bill, 2024, introduced by Union Minister of State for Personnel Jitendra Singh, provides for “leakage of question paper or answer key”, “candidates directly or indirectly participating in a public examination in any unauthorized manner” There is mention of “to assist”. ” and “tampering with a computer network or computer resource or computer system” as a punishable offense committed by an individual, group of individuals or institutions.
The bill states, “The objective of the bill is to bring greater transparency, fairness and credibility in the public examination systems and to assure the youth that their honest and genuine efforts will be appropriately rewarded and their future is secure.”
The Bill states, “The objective of this Bill is to effectively and legally prevent those individuals, organized groups or institutions from indulging in various unfair practices and adversely affecting the public examination system for monetary or unfair gains “
Singh said the bill will cover all computer-based examinations conducted by the Union Public Service Commission (UPSC), Staff Selection Commission (SSC), Railways, banking recruitment examinations and the National Testing Agency (NTA).
Following are the unfair means/offences mentioned under the Anti-Fraud Bill:
1. Question paper or answer key leaked
2. Collusion with others to leak any question paper or answer key
3. Possession of question paper or Optical Mark Recognition (OMR) sheet without any authority
4. To assist any candidate in solving one or more questions during the public recruitment examination.
5. Providing unauthorized, direct or indirect assistance to any candidate in the public examination.
6. Tampering with answer sheets including OMR response sheets;
7. Making changes in the assessment without authority other than to correct a material error.
8. Willful violation of the norms or standards established by the Central Government for the conduct of public examination.
9. Tampering with any document necessary for short-listing the candidates in the public examination or finalizing the merit or rank of a candidate
10. Deliberate violation of security measures to facilitate unfair means in the conduct of public examination
11. Tampering with a computer network or computer system for unfair gain
12. Manipulation of seating arrangements, allocation of dates and shifts for candidates to facilitate unfair means in the examinations
