The Delhi High Court has rejected a petition by a student seeking correction in Class 10 internal assessment marks on the CBSE portal, saying that if schools were allowed to commit errors earlier while uploading the marks and the board If allowed later there would be “complete anarchy”. The petitioner, who is a student of a CBSE-affiliated school in Oman, approached the court after she learned that despite scoring 20 out of 20 marks in a paper in the internal assessment, her final Class-10 result was not out. The result declared by the Central Board of Secondary Education (CBSE) revealed that she was given only 18 marks. The petitioner argued that there is no dispute on the fact that he was awarded 20 marks and he should not be harassed due to the fault of the school.

The court said the ban on subsequent corrections is in public interest and schools are advised to exercise caution while uploading marks. “In my considered opinion the injunction is in the utmost public interest. Schools in India as well as abroad are affiliated to CBSE. If schools are allowed to make errors while uploading the marks of students on the CBSE website and thereafter, CBSE is asked to correct the marks awarded at its own level, complete anarchy will result,” the judge said. he said.

“CBSE will also not be in a position to accept such requests blindly, and if this practice is allowed, independent verification will have to be done in each such case to ascertain the actual marks awarded to the candidate… . It will be a matter of debate whether CBSE will ever be in a position to declare the final results of all the students,” he said. The court said that the circulars issued by CBSE have not been challenged in this case and hence, there is no “sustainable grievance” in the petition.
