The Artificial Intelligence (AI) systems are being deployed in important domains such as fast governance, finance, policing, healthcare and education. From automating loan approval to law enforcement in hospitals and facial recognition in algorithm triazing, these technologies are shaping decisions that significantly affect human life. While AI promises efficiency and scalability, its rapid adoption has removed our ability to ensure transparency, accountability and fairness, increasing serious legal, moral and psychological concerns.

The AI ​​systems are not naturally fair, as their algorithms depend on mathematical models and data, while fairness is a subjective, reference-specific concept that opposes simple volume stagnation, making prejudice blindness a main range.

The ‘Black Box’ algorithm is contained at the center of the problem, the AI ​​system whose internal argument is either very complex for human understanding or is deliberately opaque due to ownership restrictions. These systems often process large amounts of data and produce results without offering intelligent reasons for their decisions. This lack of transparency makes it difficult to audit or challenge the results, especially when decisions are discriminatory or wrong.

Consider the case of Apple Card (2019), where customers reported that women were being given a lower credit limit than men with similar profiles. Similarly, the Compass algorithm used in American courts has been shown to demonstrate racial bias against black defendants. In India, automated systems in welfare schemes like Aadhaar-Juda PDs have wrongly excluded beneficiaries due to algorithm errors, limited support is available.

The principle of clarity in algorithm decision making is closely linked to the basic legal principles of the fixed process, natural justice and non-discrimination, all of which are necessary that individuals affected by a decision must be informed for the reasons behind it. Without such transparency, the affected individuals cannot take measures or measures against unjust or biased decisions made by AI systems.

Under the General Data Protection Regulation (GDPR) of the European Union, under Article 22, “the right not to be subject to the decision based on automatic processing only”, and, in some interpretations,, “the right to clarification”. This global AI regulation has become a reference point for debate. In India, however, such rights are absent from the current law.

Recently enacted Digital Personal Data Protection Act, 2023, clearly does not provide the right to clarification in algorithm decisions. Although it emphasizes consent and data processing principles, it stops addressing automated decision making, an important ingestion, which is looking at the increasing use of AI in welfare distribution, education, recruitment and policing.

From a moral point of view, explanation is necessary to conserve consent, personal autonomy, and dignity, main values ​​under Articles 14 and 21 of the Constitution of India.

An incident occurred in 2015 when Amazon discontinued an experimental AI-based recruitment equipment due to her discriminatory prejudice against women. Developed to automate the re -starting screening, the system handed over scores based on patterns mainly in the male resumes presented in a decade, which punish the conditions such as ‘women’ and graduation from women’s colleges. Despite efforts to neutralize specific prejudices, the dependence of the equipment on historical data ended gender inequalities, which ended it. The phenomenon underlines the challenges of embedding fairness in the AI ​​system, which highlights the need for strong data tests and moral ideas in algorithm hiring processes to reduce unexpected discrimination.

The possible solution to this development is an inclusion of AI (XAI), which refers to a suit of methods and equipment to understand the decisions of the AI ​​system more transparent and humans. The XAI enables stakeholders to understand how an AI model reached a particular decision, making it possible to detect errors, prejudice, or unexpected results.

XAI techniques can be broadly divided into model-specific and model-unquentionist approaches. Model-specific methods apply to naturally interpretable algorithms such as decision trees or linear regression, where the argument behind predictions is relatively transparent. In contrast, model-economic techniques can be applied to any algorithm, including complex models such as deep nerve networks, which are notorious. The two widely used model-unknown tools are lime (local interpretable model-unknown explanation), which creates a simple model around each decision and explains individual predictions, and shapes (cursed additive explanations), which gives the credit for each input facility based on its contribution to the output using concepts from sports theory.

However, deploying XAI on a scale comes with challenges. Often a business is closed between accuracy and clarity; Transparent models are usually less powerful than black-box models. Additionally, non-technical stakeholders explain complex outputs, especially in India’s multilingual and socio-economicly diverse population, make the task even more difficult. Despite these obstacles, the XAI AI is essential for the creation of confidence and accountability in the system.

While understanding is important for responsibility, complete transparency can increase serious concerns. In India, tech companies may oppose the disclosure of algorithm details due to intellectual property or security risks, especially in areas such as Fintech or Healthtech.

Similarly, public agencies using AI to detect monitoring or fraud make up their system to manipulate their system if the models are very transparent. There is also a trade-band between accuracy and clarity. Complex models such as nerve networks often improve simple, explanatory people. Replacing them for complete transparency can reduce effectiveness in important applications.

A major gray field lies in defineing who is the clarification for. Can it be understood to experts, regulators or general public? In linguistic and educationally diverse countries like India, it becomes even more complicated. Thus, while clarification is necessary, it should be balanced with safety, performance and reference-specific requirements. Clear rules are necessary to avoid both oversiomphilization and opacity.

AI requires cooperation in areas including technologists, policy makers, moralists and civil society to address the black box problem in AI, which should work together to ensure responsible AI deployment.

An important step is to make the algorithm effect assessment (AIA) mandatory before the public use of AI, especially in sensitive areas such as welfare, policing or work. These assessments can help identify bias, risk and unexpected losses. Additionally, public audit, transparency register, and clear prevention mechanisms should be installed to ensure accountability. AI literacy among citizens is equally important. People should understand how algorithm systems affect their rights and are empowered to question them.

For India, it is an opportunity to lead with an right-based, inclusive AI structure. A balanced approach will be important to create public belief in the AI ​​system by prioritizing innovation while protecting democratic values.
