Actor Akshay Kumar recently successfully added his name to the growing list of celebrities who have managed to protect their personality rights with legal intervention. The Bombay High Court on Thursday protected Akshay’s personality rights and took note of the ‘really dangerous’ nature of the star’s realistic deepfakes being created using artificial intelligence. This order was made available on Thursday.

“In the context of both images and videos, the morphing is so sophisticated and deceptive that it is almost impossible to understand that these are not genuine images/videos of the plaintiff (Kumar),” the high court said, according to news agency PTI.
Akshay had filed a suit in the HC against several websites and social media platforms that were misusing his photos, videos and name without any rights. In an interim application, the actor had sought removal of all such material and an injunction from future use.
The court in its order said that the deepfake video of the actor making communally inflammatory remarks and statements about Rishi Valmiki is extremely worrying. “The consequences arising from the dissemination of such material will be most severe and severe indeed,” the order said.

The order also said, “The consequences that can arise from the dissemination of such content are indeed the gravest and gravest.” The order particularly expressed concern over the deepfake video of the actor making communally inflammatory statements about Rishi Valmiki.
The court also said that being a famous actor, Akshay has rights over his personality including his name, screen name, image, voice, tone and distinctive performance. The court said that a case was made out for granting interim protection and preventing persons from infringing the actor’s personality rights and/or misusing them without permission.
The bench ordered removal of all such content from social media platforms and prohibited posting of any such content in future. In his plea, Kumar had sought protection of his personality rights amid the rise of deepfake videos, saying such content has not only damaged his reputation but also has major consequences. The petition seeks to put a stop to the ongoing violation and unauthorized commercial exploitation of his personality and publicity rights, including his real name, screen name “Akshay Kumar”, image, likeness, voice, distinctive performance style, mannerisms and other identifiable characteristics.
