New Delhi. Mobile phones are used extensively in frauds done using technology. People are often cheated through calls and messages. Keeping this in mind, the government is now planning to take strict action against spam calls or messages. The central government is going to classify such calls or unwanted messages as unfair business activities. For this, some new guidelines will be issued under the Consumer Protection Act.
The move will make those making such calls or sending messages criminally liable under consumer protection laws. Currently, under Section 2 (28) and 2 (47) of the Consumer Protection Act, 2019, inappropriate or unsolicited commercial communication is considered a deceptive and unfair trade practice.

According to media reports, the Consumer Affairs Department is working on bringing guidelines in this regard in a few months. These directions will put accountability on telemarketers and their key entities such as banks, real estate companies or any other business that has direct interaction with consumers. Because it is these institutions that constantly contact consumers to sell their products and services. Their doing this again and again irritates the consumers. Besides, under the guise of this, many times criminals also commit fraud. These proposed guidelines will define what constitutes such fraudulent calls. Through these guidelines, it will be ensured that whatever communication takes place is through authorized channels only.
Let us tell you that in February 2024, a committee was formed to make guidelines regarding unwanted commercial calls. It was formed by the Ministry of Consumer Affairs. After this a suggestion was given to telemarketers of all areas. The suggestion was to put 140 in front of your phone number. This was done so that consumers know from where the call is coming to them.
