The Waqf (Amendment) Bill of Parliament 2025, AIMIM chief and MP Asaduddin Owaisi and Congress MP Mohammad Jabde, the Supreme Court, challenged the constitutional validity of the bill and transferred it to the Supreme Court.
In his petition, Congress MP Mohammad Jabde challenged the amendments to control Waqf in the 1995 Act, claiming that it violated constitutional provisions, and said “unevenly enhances the state’s intervention”.
The petition was alleged that the bill imposed a “arbitrary ban” on Waqf properties and their management, which reduces the religious autonomy of the Muslim community.
What does the petition say?
The petition filed by the Congress MP states that the Waqf Amendment Bill, 2025, violates constitutional rights that are guaranteed under Article 14 (right to equality), 25 (freedom to practice religion), 26 (freedom to manage religious affairs), 29 (minority rights) and 300A (right to property).
The Congress MP says that non-Muslim trusts enjoy self-regulation of a certain degree, but the “WAKF Act, 1995 (” WAKF Act “) enhances the state intervention in Waqf cases. This type of treatment is a shortage of a proper nexuari for violation of Article 14, which is a reasonable to receive a proper manner.”
Talking with Annie after transferring the Supreme Court, Mohammad Jabde said, “Many people in India will file this petition, many parties will do so. In Parliament, everyone in the opposition said that it is unconstitutional. It is a religious body – you are providing freedom to non -Muslims … How can you snatch it?”
“If you have a number, it does not mean that you have passed anything and do something illegal … We have challenged it. We hope that the Supreme Court will take cognizance of this and it will be canceled as soon as possible (bill) as soon as possible.”
The bill was passed with voting in favor of 128 members in the Rajya Sabha and opposing 95. It was passed in the Lok Sabha in early April 3, in which 288 members supported it and 232 against it.
