The Supreme Court of South Africa has given a historic verdict. Now if the husband wants, then you will be able to adopt the wife’s surname. The court overturned the law considering it as colonial tradition and gender discrimination.

Pretoria: The highest court of South Africa has given a decision to change history. Now the husband will be able to adopt his wife’s surname there. This right was limited to women till now, that is, after marriage, the wife could adopt the husband’s surname, but this path was closed for the husband. The court overturned the law, considering it as gender discrimination. The constitutional court admitted that this law was actually a result of colonial era. It was only after the arrival of European colonialism and Christian missionaries that the woman should adopt the husband’s surname after marriage. Whereas in many African cultures, even after marriage, the woman retained her name and the children were often recognized by the mother’s clin name. The court said that this patriarchal thinking still dominates the society and now the time has come to end it.

Two couples fought for surname

Two couples fought this fight together. Henry Van Der Merwe wanted to adopt his wife Jana Jordaan’s surname, but was stopped. At the same time, Andreas Nicolas Bornman wanted to create a bornman-donnelly by adding his wife’s surname donnellly with his name, but the law also refused. These couples challenged in the lower court and won. Later reached the court to strengthen this order. Now he won at the Supreme level too.

Parliament will have to change

After this decision, Parliament will have to amend the Births and Deaths Registration Act. Only then the new right will be fully implemented. The court made it clear that South Africa has made a lot of progress in gender equity, but there are still laws and traditions which are old and discriminated.

Government also supported

The interesting thing in this case is that the ministers of the government also stood against this law. Home Minister Leon Schreber and Justice Minister Mamoloko Kubayi admitted in the court that this law is outdated and should be replaced. At the same time, the legal institution named Free State Society of Advocates also came out in support of the couples and said that not to give this right to men is to promote inequality and stereotypes.

What happens in India?

In India too, women often adopt the husband’s surname after marriage. However, in many modern families, women retain their names or hyphenses. But the examples of men adopting their wife’s name are very few. This decision of South Africa will cause discussion all over the world and it can also debate it in India. After all, why should there be pressure on the wife to change the name and the husband does not get this option?
