Justice C Hari Shankar directed JNU to provide all facilities to the student within a week of the announcement of this decision

The Delhi High Court on Monday directed JNU to provide free hostel accommodation to a visually impaired student expelled from the hostel along with other rights that a disabled student is entitled to under the law and policies. University until completion of his master’s degree. Justice C Hari Shankar directed Jawaharlal Nehru University (JNU) to provide all facilities to the student within a week of the announcement of this decision.

The high court accepted the plea of Sanjeev Kumar Mishra, 49, challenging his eviction from the hostel on the ground that the rules in force do not permit a student pursuing a second postgraduate course to stay in the hostel. Therefore, the petitioner, as a matter of right, is entitled to hostel accommodation provided by JNU within its campus free of charge, along with all other rights to which a student with disability is entitled under the law and policies of JNU. The High Court said, till the completion of the postgraduate degree course in Sociology.

The High Court said that it is indeed ironic that JNU is seeking to defend its case by relying on the fact that the petitioner, a 100 per cent visually impaired student, has provided a residential address 21 km away from the JNU campus. “No further comment is required on the submission,” it said, adding that no empirical data has been provided by JNU to show that it is unreasonable to expect the petitioner to be provided hostel accommodation. will be.

The court said that a student who has already undertaken a course and completed it is equally entitled to accommodation as a student who is joining JNU for the first time. is also entitled to a place to live. Advocate Rahul Bajaj, representing the petitioner, said this rule cannot be applied in all cases while not taking into account the physical disabilities that individual students may be suffering from.

Counsel for JNU said that the denial of hostel accommodation to the petitioner as a result of his enrollment in the second master’s degree course was entirely in accordance with the JNU Hostel Manual, which did not include students who had completed their qualification from places outside Delhi. Had completed the exam and was not resident. If they already have a degree or are studying in JNU at the same level with hostel accommodation, they will be removed from the eligibility for hostel accommodation. Counsel submitted that this exception applies to the petitioner and, therefore, he is not entitled to hostel accommodation.
