In view of the increasing number of students enrolling in coaching centers over the last year ending their lives or suffering from mental health issues, the Center has put in place a legal framework to regulate these institutions in the states, which Prevents them from admitting underage students. at the age of 16, make “misleading claims” about getting a rank or admission into top institutions, as well as orders classes to be held for no more than five hours a day to avoid “undue stress”. The proposed rules titled Guidelines for Regulation of Coaching Centers 2024 state that no coaching center will make “misleading promises or guarantees of rank or good marks” to parents/students for enrolment. They also prohibit centers from enrolling students under the age of 16, or require student enrollment to occur only after secondary school examinations. Furthermore, they do not allow coaching centers to be registered unless they have a counseling system as per the requirements of the guidelines.
As per the guidelines, coaching centers should conduct workshops and sensitization sessions from time to time regarding the mental health of students. “Due to high competition and academic pressure on students, coaching centers should take steps for the mental well-being of students and conduct classes without putting undue pressure on their students. At the same time, they should put in place mechanisms for immediate intervention to provide targeted and sustained support to students in crisis and stressful situations,” he says.
The ministry’s letter asking states to implement the proposed guidelines said that in the absence of any set policy or regulation, the number of unregulated private coaching centers is increasing in the country. “Incidents of excessive fees being charged from students by such centres, undue stress on students resulting in suicide by students, loss of precious lives due to fire and other accidents, and many other malpractices being practiced by these centers have been widely reported in the media. have been done…Accordingly, guidelines have been prepared and are being sent for consideration by the States/UTs through appropriate legal framework,” the letter signed by Deputy Secretary Devendra Kumar Sharma reads.
Since education is a subject of the Concurrent List and secondary education is largely under the state governments, they have been asked to implement the guidelines through this legal framework.
Some of the coaching centers that News18 contacted for comment said they could not comment without studying the guidelines in detail.
Last year, 26 students preparing for competitive exams like JEE and NEET for admission to engineering and medical colleges enrolled in coaching centers in Rajasthan’s Kota, took their own lives – the highest number of suicides in the district since 2015. Kota is the coaching hub of India. The entire city is full of coaching centers for JEE and NEET, where lakhs of students are enrolled right from class 9 onwards.
The guidelines define a coaching institute as tuition, instruction or guidance in any branch of education offered to more than 50 students. It does not include counselling, sports, dance, theater and other creative activities.
As per the rules, a coaching center will ensure weekly off for the students as well as tutors. There will be no assessment test or examination on the day following the weekly holiday. Also, the guidelines do not allow centers to conduct classes for more than five hours daily.
According to the new rules, these institutes will conduct coaching classes in a way that is not too burdensome for any student. The timing of coaching should neither be “too early in the morning nor too late in the evening”.
“During important and popular festivals in the respective region, the coaching institute will have to adapt the holidays in such a way that students can connect with their families and feel emotionally encouraged,” the guidelines said.
Most of these coaching institutes are known for the rigorous hours of study required by the students without any weekly offs or even during festivals. The Kota administration had last year made it a rule for coaching centers to give weekly leave to students and not conduct any examination on that day or immediately after it after it observed a rise in the number of student suicides the day after the examination. The guidelines make it mandatory for coaching institutes to register themselves with the appropriate government authority. “No person shall provide coaching or establish, operate, manage or maintain a coaching center only after prior registration of such coaching center in accordance with the provisions of these guidelines,” it says.
Every registered coaching center shall apply for renewal of registration certificate to the competent authority. Also, the rules say that state governments will create an online mechanism to facilitate registration of these centers in a faceless manner with minimum human interface.
The proposed rules also prevent coaching centers from hiring tutors with qualifications less than graduation. The guidelines make it clear that no coaching center can be registered if it has less than the minimum space requirement per student. It mandates allotment of “minimum one square meter area” for each student during a class or batch. The rules stipulate that a coaching center must have updated details of the tutors’ qualifications, courses/curriculum, duration of completion, hostel facilities (if any), fees charged, easy exit policy, fee refund policy, number of Must have a website. The guidelines state that coaching classes for those students who are studying in an educational institution like school will not be conducted during the timings of their institutions/schools so as to avoid dummy schools.
The guidelines also say that if the student has made full payment for the course and is leaving in the middle of the scheduled period, it is mandatory for the coaching institute to refund the fees within 10 days. If the student is staying in the hostel of the coaching center then the hostel fees, mess charges etc. will also be refunded.
The rules also state that coaching centers will have a committee to redress the grievances of students. The competent authority may take steps to ensure that a counseling system is developed by the coaching center and is easily available to the students and parents.
