In case of violation of rules, it can issue challan and can also impound the vehicle. All this is necessary to make the drivers follow the rules to maintain the traffic system. During checking, traffic policemen also do some things which the law does not allow them to do. It is a common practice for traffic policemen to forcefully remove the keys from the car or deflate the tyres. But, does the traffic police have the right to do this? According to the law, the answer is ‘no’.
No traffic policeman has the right to take out the key from the vehicle or deflate the tyre. You may also be asked to show documents like your driving license, vehicle registration papers, insurance and pollution certificate (PUC). If a traffic policeman does this, it is a violation of the law and you can file a complaint against them. But, people still tolerate all these arbitrariness due to lack of information.

What does the law say?
According to the Indian Motor Vehicles Act 1932, only officers of Assistant Sub-Inspector (ASI) rank or above can issue challan for violation of traffic rules. Only ASI, Sub-Inspector and Inspector have the right to impose fine on the spot. Traffic constable or home guard cannot even issue challan of the vehicle. If the vehicle does not have RC, the vehicle can be confiscated, but the Indian Motor Vehicle Act does not allow anyone to forcefully snatch the key or remove the air.
Important rules for challan
The traffic policeman can impose fine on you only if he has a challan book or e-challan machine. Without any of these things, he cannot collect fine from the driver in the name of challan. It is also necessary for the traffic police employee to be in uniform. If the traffic police is in civil dress, the driver can also be asked to show their ID card.
