Sometimes some traffic policemen even take away the keys of someone’s bike or car. Or they let out the air of a vehicle parked in a ‘no parking’ zone. In such a situation, many people wonder whether traffic policemen can legally do both these things.
The answer to this question is ‘no’. According to the Indian Motor Vehicles Act, no traffic policeman or constable has the right to take out the keys of anyone’s vehicle or let out air from the tyres of a car or bike. If he does so, he is breaking the law and action can be taken against him.

What does the law say?
According to the Indian Motor Vehicles Act, only a traffic police personnel above the rank of Assistant Sub-Inspector can impose a fine for violating traffic rules. Only ASI, Sub-Inspector and Inspector are allowed to impose fine on the spot. Traffic constables or home guards cannot do this. ASI or SE can also challan you for violating traffic rules. If the documents are not complete, the vehicle can be impounded. But, neither can the car’s tyres be let out forcefully nor can they snatch the keys.
Do not give money without a receipt
A traffic policeman can fine you only if he has a challan book or an e-challan machine. Without any of these things, he cannot collect fine from the driver in the name of challan. It is also necessary for the traffic police personnel to be in uniform. If the traffic police is in civil dress, then the driver can ask for his identity card.
