The University Grants Commission (UGC) has issued a notice to all higher education institutions asking them to refrain from admitting foreign nationals into Open and Distance Learning (ODL) programmes. The notice highlights the eligibility criteria specified in Annexure III of the UGC Regulations that only students resident in India are eligible for enrollment in the ODL programmes.
Under Regulation 23 of the UGC, ODL Programs and Online Programs Regulations, 2020, “(3) Enrollment of the learner (for Open and Distance Learning mode): A learner residing in any part of the country shall enroll for any course of higher education offered by can also enroll in the program. Institutions recognized by the Commission for offering programs under open and distance learning mode, provided that the higher educational institution shall conduct all activities for the learner such as admissions, contact programmes, examinations etc. strictly within the territorial jurisdiction of the higher educational institution As specified herein. The higher education regulator in the country said the Home Ministry has notified that no student visas will be issued to foreign nationals who are sponsored by franchisees, educational institutions running off-campus centres, open universities offering distance learning programmes. “Study centres, educational institutions running “outreach” programs and offering courses without any statutory approval from regulatory authorities.”
“In view of the above, HELS recognized/entitled to offer ODL programs are directed not to enroll any foreign national in the Open and Distance Learning (ODL) programmes. “Accordingly, only learners resident in India can be enrolled in ODL programs in compliance with the territorial jurisdiction for all activities of the learner as defined in Annexure-III of the UGC (ODL Programs and Online Programmes) Regulations, 2020,” the notice read. .
