Amid the ongoing controversy and political turmoil, the Supreme Court on Tuesday refused to cancel and re-conduct the NEET-UG 2019 exam.
A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra heard arguments on several petitions related to the NEET exam and seeking re-examination on the grounds of question paper leak and other irregularities.
The court said that The order to cancel the entire NEET-UG exam is not appropriate On the application of the well-established principles enunciated by it.
What did the Chief Justice say?
1) The fact that the leak in NEET-UG 2024 happened in Hazaribagh and Patna is not a matter of dispute.
2) At this stage, the Court has independently examined the data placed on record by the NTA. There is no material on record from which it can be concluded that the result of the examination is tainted or that there has been a systematic violation of the sanctity of the examination.
3) Bar & Bench quoted the Chief Justice as saying that the data available on record does not indicate any systematic leakage of the question paper to indicate any disruption of the sanctity of the examination.
4) The Court is guided by the well-established test of the possibility of separating the tainted from the untainted. Further, it is important to clarify that if the investigation reveals the involvement of an increased number of beneficiaries, action will be taken against them, Live Law quoted the CJI as saying.
5) The court said that if the investigation reveals increase in the number of beneficiaries, action will be taken against any such student at any stage despite the completion of the counselling process.
6) The Chief Justice said that he felt it would not be appropriate to issue fresh directions. NEET-UG for current year This will have serious consequences for more than 24 lakh students who appeared in this examination.
7) The court said that the NTA had conducted a special examination for 1,563 candidates, and they were given the option to either appear in the re-examination or forgo the grace marks and the NTA is directed to act accordingly.
8) It would be important to clarify that if any student has any individual grievance which is not related to the issues resolved in this judgment, they will have the freedom to pursue their rights and remedies in accordance with the law, Live Law quoted the CJI as saying.
9) The Court further said that to approach the High Court they would have to withdraw their petitions pending in this Court.
10) On the issue of two correct options for Physics question, the apex court said the expert panel clearly stated that there is only one correct option, which is option four. Accepting the report of IIT Delhi, the CJI said that accordingly, the NTA shall revise the result of NEET UG 2024 on the basis of option 4, as stated above, being the only correct option.
