Mumbai: Jet Airways founder Naresh Goyal has moved the Bombay High Court for bail in a money laundering case on the grounds that both he and his wife were suffering from terminal cancer.

A single bench of Justice NJ Jamadar said on Tuesday that it will hear the petition on May 3.

In his petition, Goyal said that the medical conditions of his wife and himself have affected his mental health and as per a psychological report, he is suffering from severe depression.

“As per reports, Goyal is severely depressed and fearful of the future, has suicidal thoughts and a sense of hopeless resignation,” the petition said.

The petition said that in the present situation, not allowing Goyal to live with his wife is a gross violation of basic human rights.

“At the end of their lives, when both of them are battling life-threatening conditions, they (Goyal and his wife) should be allowed to support each other as each other’s primary caregivers,” the petition said. should be given.”

It added that Goyal is currently undergoing chemotherapy, after which he will require a clean, sterile, neat and clean environment and hence cannot be sent back to jail.

“The special court has acted by denying him (Goyal) bail on the ground that mere hospitalization would suffice without understanding the need for post-treatment treatment and the critical condition of his wife,” the petition said. ”

Goyal was arrested by the Enforcement Directorate (ED) in September 2023 on charges that he had committed money laundering and siphoned off loans worth crores of rupees. Canara Bank gave Rs 538.62 crore to Jet Airways.

His wife Anita Goyal was arrested in November 2023 when the ED filed its chargesheet in the case. Considering his age and medical condition, the special court granted him bail on the same day.

In February this year, a special court had allowed Goyal to be admitted to a hospital of his choice for a period of two months for medical treatment.

However, the special court had refused to grant bail to Goyal, saying that he was being provided treatment in a hospital of his choice and was being looked after by doctors.

The court had also said that Goyal’s wife was also undergoing treatment in the same hospital.

Goyal also sought bail from the High Court on the merits of the case, saying he has been implicated in a false case.

Goyal claimed that every rupee of the money received from Canara Bank was used by JIL (Jet Airways India Limited) for legitimate business purposes.

He said that he was a non-executive director/chairman of JIL and hence he had no power to manage its day-to-day affairs.

“The allegation that the money was released for illegitimate purposes is prima facie absurd,” the plea said.

It said the investigation against him has been completed and the prosecution complaint (chargesheet) has also been filed by the ED and hence his custody is not required.

Goyal said in his petition that his right to life and dignity cannot be abridged or suspended merely because he is accused of an economic offence.
