The Supreme Court on Monday stayed the notices issued by the Privileges Committee of the Lok Sabha Secretariat to the West Bengal Chief Secretary, DGP and others on the complaint of “misconduct” filed against them by BJP MP Sukanta Majumdar.
Majumdar had suffered injuries last week when BJP workers clashed with police personnel after he was stopped from leaving Sandeshkhali in violence-hit West Bengal.
The Lok Sabha Secretariat has summoned West Bengal Chief Secretary Bhagwati Prasad Gopalika and Director General of Police (DGP) Rajeev Kumar to appear before him by 10:30 am on Monday.
A team of judges, including Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Mishra, heard the arguments of senior lawyers Kapil Sibal and Abhishek Singhvi, representing the state authorities. As per PTI report, the Supreme Court bench decided to stay the orders which required these officers to be present.
Counsel for the Lok Sabha Secretariat opposed the stay by the apex court, saying this was the first meeting of the Privileges Committee.
“No charges are being filed against him. This is a regular process. Once an MP sends a notice and the Speaker feels there is something worth looking into, the notice is issued,” the lawyer said.
The bench issued notice to the Lok Sabha Secretariat and others and sought their reply within four weeks and in the meantime stayed the proceedings before the lower house panel.
The MP and others were stopped from entering Sandeshkhali, where women are agitating over alleged atrocities committed against them by Trinamool Congress leader Shajahan Shaikh and his associates.
